These Terms of Service (“Terms”) are a legal agreement between you and Papaview LLC (“Papaview,” “we,” “us,” or “our”) governing your use of the Grow phone app and TV app (together, the “App”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old to create an account. If you are under the age of majority where you live, you may use the App only with the involvement and consent of a parent or guardian.
2. The service
Grow is a free app that lets a group track shared goals visually — members contribute from their phones and the progress fills in a tree, temple, or picture on a shared display. We provide the App free of charge and may change, suspend, or discontinue any part of it at any time.
3. Your account
You are responsible for keeping your password secure and for all activity under your account. Notify us promptly if you believe your account has been used without your permission. You may delete your account at any time from within the App.
4. Acceptable use
You agree not to:
- use the App for any unlawful purpose or in violation of these Terms;
- upload, post, or share content that is illegal, infringing, hateful, harassing, threatening, sexually explicit, violent, or otherwise objectionable;
- upload content you do not own or do not have the rights to use;
- attempt to gain unauthorized access to the App, other accounts, or our systems, or interfere with or disrupt the service; or
- misuse another member's information obtained through the App.
5. Content you upload
You may upload images to use as a board picture. You retain ownership of the content you upload. By uploading content, you grant Papaview a non-exclusive, worldwide, royalty-free license to store, reproduce, and display that content within the App for the purpose of operating the service — for example, showing it to members of your group and on TVs paired to your group.
You represent and warrant that you own or have all necessary rights to the content you upload and that it does not infringe anyone's intellectual property, privacy, or other rights and does not violate any law or these Terms.
Content moderation. We may, but are not obligated to, review content. We may remove or disable any content, and suspend or terminate any account, that we believe violates these Terms, at our sole discretion. To report content that violates these Terms, email support@papaview.com; we aim to review reports and take appropriate action within 24 hours.
6. Intellectual property
The App and its original content, features, and functionality (excluding content you upload) are owned by Papaview and are protected by intellectual property laws. Any third-party artwork, imagery, or other materials that may appear in the App remain the property of their respective owners and are subject to their terms. We grant you a limited, personal, non-transferable, non-exclusive license to use the App for its intended purpose.
7. Disclaimer of warranties
The App is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, timely, secure, or error-free, or that any data will be preserved. The App may rely on infrastructure that is not continuously available, and we do not guarantee uptime.
8. Limitation of liability
To the fullest extent permitted by law, Papaview and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of the App. Because the App is provided free of charge, our total liability for any claim will not exceed US $100.
9. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms or to protect the service or other users. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination (including Sections 5–8 and 10) will survive.
10. Governing law
These Terms are governed by the laws of the State of Idaho, United States, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located there for any dispute.
11. Changes to these Terms
We may update these Terms from time to time. We will change the “Last updated” date above and, for material changes, provide notice within the App. Your continued use of the App after changes take effect means you accept the updated Terms.
