DMCA Policy

Last updated: draft

Papaview respects intellectual-property rights and follows the notice-and-takedown procedure of the Digital Millennium Copyright Act (17 U.S.C. § 512). This page explains how to submit a takedown notice, how a user whose content was removed can send a counter-notice, and how we handle repeat infringers.

Designated Copyright Agent

Our designated agent for DMCA notices is:

Copyright Agent — Papaview [NAME — TO BE REGISTERED] [STREET ADDRESS] [CITY, STATE, ZIP] Email: dmca@papaview.com Phone: [TO BE PROVIDED]

(Before launch, Papaview will register this agent with the U.S. Copyright Office as required by 17 U.S.C. § 512(c)(2).)

How to submit a takedown notice

To report content you believe infringes your copyright, send a notice to dmca@papaview.com that includes each of the following:

  1. A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf.
  2. Identification of the copyrighted work(s) you claim have been infringed.
  3. The URL(s) or specific description(s) of the material you want removed so we can locate it.
  4. Your contact information (name, address, phone number, email).
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf.

Under 17 U.S.C. § 512(f), you may be liable for damages (including costs and attorneys' fees) if you knowingly materially misrepresent that material is infringing.

What we do when we receive a valid notice

  1. We remove or disable access to the identified material expeditiously.
  2. We notify the user who uploaded it, and forward a copy of the notice.
  3. We log the notice for repeat-infringer tracking.

Counter-notice

If your content was removed and you believe that was a mistake or misidentification, you can send us a counter-notice. Email dmca@papaview.com with:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and phone number, and a statement that you consent to the jurisdiction of the U.S. federal court for the district in which you are located (or, if you are outside the U.S., for any district in which Papaview may be found), and that you will accept service of process from the person who provided the original notice.

If we receive a valid counter-notice, we may restore the content 10 business days after forwarding it to the original reporter, unless the reporter files a lawsuit against you in the meantime.

Repeat infringer policy

In appropriate circumstances, we will terminate accounts of users who are repeat infringers. We generally consider “repeat” to mean three or more separate valid DMCA notices within a 12-month period, but we reserve the right to act sooner for serious or willful infringement.
