These Terms of Service (“Terms”) form a legal agreement between you and Papaview (“we,” “us,” or “Papaview”) governing your use of papaview.com and the Papaview software and services (collectively, the “Service”). By creating an account, clicking “I agree,” or using the Service, you accept these Terms.
1. Eligibility
You must be at least 13 years old to use the Service and have the legal capacity to enter into a binding contract. Parents and guardians are responsible for any content their minor children upload through them.
2. Accounts
You're responsible for keeping your credentials secure and for everything that happens under your account. One person per account. Contact us immediately if you suspect unauthorized access.
3. Subscription, billing, and cancellation
Paid plans are billed in advance by Stripe on a monthly or yearly cycle. You authorize Papaview and Stripe to charge the payment method on file. Subscriptions renew automatically until canceled from Settings → Billing. Cancelations take effect at the end of the current billing period. Except where required by law, fees are non-refundable.
If a payment fails, we'll retry and notify you. If we cannot collect after a reasonable grace period, your account may be downgraded to the free tier and content over the free quota may be hidden until payment resumes (it is not deleted for 30 days).
4. Your content; license to us
You own the photos, videos, voice notes, captions, and other content you upload (“User Content”). You represent that you have the rights to upload and share that content, and that sharing it through Papaview does not violate anyone else's rights.
You grant Papaview a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, and transcode User Content solely as needed to provide the Service to you and people you authorize — including delivering content to displays you own, encoding for stream providers you connect (e.g., YouTube / Facebook / Vimeo), and generating derivative versions (thumbnails, downscaled display copies, animated GIF resizes). This license ends when you delete the content, subject to the retention carve-outs below.
5. What you may not upload or do
Your use of the Service is subject to our Acceptable Use Policy, which is part of these Terms. Without limiting the AUP, you must not:
- Upload child sexual abuse material, sexual content involving minors, or content that exploits minors in any way.
- Upload content you don't have the right to share.
- Harass, threaten, or defame anyone.
- Interfere with, probe, or attack the Service.
- Resell, sublicense, or use the Service in a way that competes with Papaview.
6. Content moderation and reporting
We may review, restrict, or remove User Content we reasonably believe violates these Terms or applicable law, including child-safety, intellectual-property, and harassment violations. We scan uploads against the NCMEC hash list of known child sexual abuse material and are required by U.S. law (18 U.S.C. § 2258A) to report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC). We may preserve content for 90 days after a report for law-enforcement purposes even if you attempt to delete it.
7. Intellectual property (our side)
Papaview, the Papaview name, logo, and all software are owned by us and licensed to you as part of the Service. You may not copy, modify, reverse-engineer, or distribute our software outside of what we expressly permit.
8. Copyright — DMCA
We respond to valid takedown notices under the Digital Millennium Copyright Act. See our DMCA Policy for the notice procedure and counter-notice rights. Repeat infringers will have their accounts terminated.
9. Third-party services
The Service integrates with third-party services (Stripe, Supabase, Resend, Cloudflare, YouTube, Facebook, Vimeo, Dropbox, Google). Your use of those services is governed by their terms and privacy policies; we are not responsible for them.
10. Termination
You can delete your account at any time from Settings. We can suspend or terminate an account that violates these Terms or the AUP, or for legal, safety, or security reasons. On termination, access to the Service ends; content is deleted within 30 days except where retention is required by law.
11. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant uninterrupted or error-free service.
12. Limitation of liability
To the fullest extent permitted by law, Papaview's aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) $100. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages — including lost data, lost profits, or substitute-service costs — even if we've been advised of the possibility.
13. Indemnification
You agree to defend and indemnify Papaview against third-party claims arising out of your content, your breach of these Terms, or your violation of any law or third-party right.
14. Governing law and disputes
These Terms are governed by the laws of the State of [STATE], excluding its conflicts-of-law rules. Any dispute arising under these Terms will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted remotely or in [CITY, STATE]. You and Papaview each waive the right to a jury trial and to participate in class actions.
30-day opt-out: You may opt out of this arbitration clause by emailing legal@papaview.com with the subject “Arbitration Opt-Out” within 30 days of first accepting these Terms.
15. Changes to these Terms
We may update these Terms. Material changes take effect at least 30 days after we email you. Continued use after the effective date means you accept the updated Terms.
